We suggest, if you’re looking for someone to help with your finances, you choose someone with a good history of managing money. If that person has been declared bankrupt, they won’t be able to act as a property and finance attorney, but can still act as a health and welfare attorney. Certain marriages are treated as if they never took place. These are called void marriages. They are marriages which do not meet the requirements of United Kingdom law. An example of a void marriage is one where the partners may not marry because they are related.

Don’t feel you have to choose someone just because you don’t want to offend them. If you want them to feel involved, you could make them a ‘person to notify’ instead. (See part A6 of this guide.) Who can be an attorney? A Certificate Provider must be independent of the application, not related to the donor or attorney(s), over the age of 18 and have known you well for at least two years. It’s also a legal requirement that the marriage schedule is returned to the Register Office and added to the electronic register - but a marriage is still valid if this doesn’t happen. Some marriages may have met the requirements of United Kingdom law when they took place but may then be annulled. These are called voidable marriages. There are a number of situations where marriages are considered voidable, for example if one partner has been granted a full gender recognition certificate (see under Transgender people), or if one of the partners did not give valid consent to the marriage because the consent was given under duress. Either partner can seek to annul the marriage but if neither partner does, the marriage will be valid. the replacement attorneys will take over, making all joint decisions instead of your original attorneys If you have been married in a way that is not recognised as valid in the United Kingdom, the marriage can take place again according to United Kingdom law provided that both you and your partner meet the requirements described earlier. BigamyIf your original attorneys have to make all or some decisions jointly and one can no longer act, your replacement attorneys will make those joint decisions instead. Both your remaining original attorneys and your replacements can make any decisions that don’t have to be made jointly. You must give notice at your local register office, in the council area you live in. This applies even if you’re getting married in a different part of the country. This must be done face-to-face, and both you and your partner must be present.
